摘要: 水利工程属于典型的公共基础设施,政府对工程质量进行监督管理是维护公共利益的一项制度安排。在中国,以政府为龙头,市场、社会为两翼的水利工程质量治理格局已初步形成,解决政府监管乏力的问题已迫在眉睫。采用“现状分析-可行性分析-角色分析-路径选择”的研究思路,通过文献研究、实证研究、归纳演绎分析了当前政府、市场及社会质量管理现状,对监督执法一体化的可行性及其在新型协同关系中扮演的角色与定位进行论证,并为监督执法一体化的制度落地提出了路径选择。研究结果表明,监督执法一体化是水利行业行政体制改革的重要举措和自然选择,具有合法性、合理性、可操作性,是水利工程质量治理现代化的重要抓手与切入点。

Abstract: Water conservancy projects are typical public infrastructures. The government's supervision and management on project quality is an institutional arrangement to safeguard public interests. In China, the pattern of water conservancy project construction quality management which is led by the government and the market and society as assistance, has initially formed. However it is urgent to solve the problem of weak government supervision. This paper adopts the research idea of "status analysis, feasibility analysis, role analysis, path selection". Through literature research, empirical research, induction and deduction, the current situation of quality management by government, market and social is analyzed. The feasibility of supervision and enforcement integration and its role and position in the new collaborative relationship is demonstrated. The path choice of implementing the supervision of the law enforcement integration system is put forward. The results show that the integration of supervision and law enforcement is an important measure and natural choice of the reform of the administrative system of water conservancy industry. It is feasible in legal theory, reasonable in implementation and practical operability, and is an important starting point in the modernization of water conservancy construction quality control.
